DECRETO 6 novembre 2007 - Emissione, in modalita'' elettronica, della tessera di riconoscimento di cui al decreto del Presidente della Repubblica 28 luglio 1967, n. 851, rilasciata ai magistrati ordinari, ai dirigenti ed al personale di ruolo e non di ruolo dell''amministrazione giudiziaria.
Visto il decreto del Presidente della Repubblica 18 luglio 1967, n. 851, recante norme in materia di tessere di riconoscimento rilasciate dalle amministrazioni dello Stato, che individua i modelli di tessera rilasciati su supporto cartaceo;
Visto l'art. 66, comma 8, del decreto legislativo 7 marzo 2005, n. 82, come modificato dal decreto legislativo 29 aprile 2006, n. 159, il quale stabilisce che le tessere di riconoscimento rilasciate dalle amministrazioni dello Stato possono essere realizzate anche con modalita' elettroniche e contenere le funzionalita' della carta nazionale dei servizi per consentire l'accesso per via telematica ai servizi erogati in rete dalle pubbliche amministrazioni;
Visto l'art. 35, comma 2, del decreto del Presidente della Repubblica 28 dicembre 2000, n. 445, in tema di equipollenza alla carta di identita' delle tessere di riconoscimento rilasciate da un'amministrazione dello Stato;
Viste le vigenti disposizioni in tema di ordinamento giudiziario, ed in particolare il regio decreto 30 gennaio 1941, n. 12 e la legge 30 luglio 2007, n. 111, che attribuiscono specifici compiti e funzioni al personale di magistratura e al personale dell'amministrazione giudiziaria;
Ravvisata l'esigenza di rilasciare al personale dell'amministrazione giudiziaria un documento di riconoscimento personale connesso con l'esercizio delle funzioni attribuite;
Visto il parere espresso in data 27 ottobre 2005 dal Garante per protezione dei dati personali in relazione all'utilizzo dei dati biometrici del personale dell'amministrazione giudiziaria per il rilascio e l'uso in rete della tessera di cui sopra in modalita' elettronica;
Visto il parere espresso in data 21 luglio 2005 dal Centro nazionale per l'informatica nella pubblica amministrazione in relazione alle speciali funzioni in materia di autenticazione informatica della tessera personale di riconoscimento in modalita' elettronica;
Decreta:
Art. 1.
Ai magistrati ordinari, ai dirigenti ed al personale di ruolo e non di ruolo dell'amministrazione giudiziaria viene rilasciata una tessera di riconoscimento, in modalita' elettronica, per l'esercizio delle funzioni proprie e con funzionalita' di autenticazione informatica per l'accesso ai sistemi informatici...
