n. 138 ORDINANZA 18 maggio - 10 giugno 2016 -
ha pronunciato la seguente ORDINANZA nei giudizi per conflitto di attribuzione tra enti sorti a seguito del decreto del Ministero dell'economia e delle finanze 17 giugno 2014 (Riparto del contributo alla finanza pubblica previsto dall'articolo 16, comma 3, del decreto-legge 6 luglio 2012, n. 95, tra le regioni a statuto speciale e le province autonome di Trento e Bolzano. Determinazione dell'accantonamento), promossi dalla Regione autonoma Valle d'Aosta/Vallee d'Aoste e dalla Provincia autonoma di Bolzano, con ricorsi notificati il 21-26 agosto e il 25-29 agosto 2014, depositati in cancelleria il 22 agosto ed il 9 settembre 2014 ed iscritti ai nn. 9 e 11 del registro conflitti tra enti 2014. Visti gli atti di costituzione del Presidente del Consiglio dei ministri;
udito nella camera di consiglio del 18 maggio 2016 il Giudice relatore Aldo Carosi. Ritenuto che, con i ricorsi iscritti rispettivamente al reg. ric. n. 9 e n. 11 del 2014, la Regione autonoma Valle d'Aosta/Vallee d'Aoste e la Provincia autonoma di Bolzano hanno proposto conflitto di attribuzione nei confronti dello Stato per l'annullamento del decreto del Ministero dell'economia e delle finanze 17 giugno 2014 (Riparto del contributo alla finanza pubblica previsto dall'articolo 16, comma 3, del decreto-legge 6 luglio 2012, n. 95, tra le regioni a statuto speciale e le province autonome di Trento e Bolzano. Determinazione dell'accantonamento);
che in particolare la Regione autonoma Valle d'Aosta/Vallee d'Aoste ha proposto conflitto di attribuzione nei confronti del citato decreto in riferimento agli artt. 117, terzo comma, 119, della Costituzione, ai principi di leale collaborazione e di ragionevolezza di cui all'art. 3 Cost., agli artt. 2, primo comma, lettera a), 3, primo comma, lettera f), 4, 12, 48-bis e 50 della legge costituzionale 26 febbraio 1948, n. 4 (Statuto speciale per la Valle d'Aosta), in relazione agli artt. 2, 3, 4, 5, 6 e 7 della legge 26 novembre 1981, n. 690 (Revisione dell'ordinamento finanziario della regione Valle d'Aosta);
