n. 54 RICORSO PER LEGITTIMITA' COSTITUZIONALE 15 aprile 2013 -
Ricorso nell'interesse della Presidenza del Consiglio dei ministri (Codice fiscale n. 80188230587), con il patrocinio dell'Avvocatura Generale dello Stato, Codice fiscale n. 80224030587, fax 0696514000 - PEC: ags.rm@mailcert.avvocaturastato.it presso i cui Uffici domicilia ex lege in Roma, via dei Portoghesi n. 12;
Contro la Regione Umbria, in persona del Presidente della Giunta Regionale pro tempore, avverso la legge n. 3 dell'8 febbraio 2013, pubblicata sul Bollettino Ufficiale n. S.o. n. 1 al n. 8 del 13 febbraio 2013, recante «Norme per la ricostruzione delle aree colpite dal sisma del 15 dicembre 2009». Con la legge indicata in epigrafe la Regione Umbria, nel dare seguito ai primi urgenti interventi statali volti ad affrontare la grave emergenza determinata dai recenti eventi sismici (OPCM 3853/2010 recante «Primi interventi urgenti conseguenti ai gravi eventi sismici che hanno colpito parte del territorio della Regione Umbria il giorno 15 dicembre 2009»), ha disciplinato la programmazione e l'attuazione degli interventi necessari per la ricostruzione e il ripristino degli immobili privati e delle opere pubbliche danneggiati dal sisma del 15 dicembre 2009 e, in particolare, per quelli siti nei comuni individuati dall'ordinanza suddetta. In particolare, la legge reca, tra l'altro, disposizioni che disciplinano l'erogazione dei contributi ai soggetti privati, l'individuazione di questi (art. 3) ed il divieto di mutamento della destinazione d'uso in atto al momento del sisma prima che siano decorsi due anni dalla data di completamento dell'intervento, a pena di decadenza dal contributo e di rimborso delle somme percepite, maggiorate degli interessi legali (art. 9). Sennonche', accanto a tali condivisibili disposizioni, la legge contiene una norma (articolo 10) affetta da evidenti profili di incostituzionalita'. Tale disposizione, infatti, al comma primo estende ai lavori privati il sistema di qualificazione SOA previsto per gli appalti di lavori pubblici dall'art. 40 del decreto legislativo n. 163/2006, recante Codice dei contratti e dagli articoli 60 ss del D.P.R. n. 207/2010 («Regolamento di esecuzione ed attuazione del medesimo codice dei contratti»).
